Influencer contract in Morocco: free template and key clauses

An influencer contract in Morocco fits on one or two pages: parties and ICE, content and dates, price in MAD with a deposit, invoice, usage rights, partnership disclosure, exclusivity, cancellation and personal data. As of October 2026 there is no influencer-specific law: the contract, the Code of Obligations and Contracts and consumer law 31-08 govern the deal.

Why sign a contract with an influencer?

In Morocco, a validly formed contract “has the force of law” between the parties (article 230 of the Code of Obligations and Contracts, DOC). Without anything in writing, each side remembers a different deal.

Writing is also required to assign or license the rights to use content (copyright law 2-00, article 41). A signed PDF or an electronic signature is enough: an electronic document has the same evidential value as paper if its author can be identified (article 417-1 of the DOC).

Which influencer contract template should I use?

Copy this template and replace the parts in quotation marks.

  1. Parties. Between “client’s company name”, ICE “…”, address “…”, the Client, and “creator’s name”, auto-entrepreneur, tax ID (IF) “…”, ICE “…”, account “@…”, the Creator.
  2. Deliverables. The Creator produces “1 Instagram Reel of 30 to 60 seconds and 3 stories”, posted on “@…” on “date”, and kept online for at least “3 months”.
  3. Approval. The Client receives the content “3 days” before posting and may request “1” round of changes, based on the signed brief.
  4. Price and payment. Total price: “6,000 MAD”. Deposit of “40%” on signing, balance within “7 days” after posting, by bank transfer.
  5. Invoice. The Creator issues an invoice showing their IF, their ICE and the Client’s ICE. If an auto-entrepreneur: “VAT exempt, article 91-II-3° of the General Tax Code”.
  6. Usage rights. The Client may reshare the content on “its Instagram and TikTok accounts” for “6 months”, in Morocco. Paid ads, billboards or TV: separate written agreement and price.
  7. Partnership disclosure. The Creator turns on the paid partnership label and clearly flags the ad. The Client asks for no false claim.
  8. Exclusivity. The Creator does not advertise a direct competitor in the “…” category for “30 days” after posting.
  9. Cancellation and delay. If the Client cancels less than “7 days” before the date, the deposit is kept. If the Creator does not post, a new date within “15 days” or the deposit is refunded.
  10. Personal data. Each party uses the data it receives (statistics, contact details, giveaway entrants) under law 09-08, for this partnership only.
  11. Governing law. The contract is governed by Moroccan law. The parties seek an amicable settlement for “15 days” before going to the competent court in “city”.
  12. Signatures. Signed in “city” on “date”, in two copies or by electronic signature.

Why these clauses: the ICE identifies the client on the invoice, precise deliverables prevent misunderstandings, a single round of changes protects the creator’s time, and exclusivity is negotiated separately because it stops the creator working with competitors.

How do I set the price and the deposit?

Start from the October 2026 market ranges: for a micro account (10,000 to 50,000 followers), 1,500 to 5,000 MAD per Instagram post, 600 to 2,000 MAD per story, 2,400 to 8,000 MAD per Reel. Details are on Instagram rates.

Example: one Reel and three stories with a micro creator, for 6,000 MAD in total. With a 40% deposit, the client pays 2,400 MAD on signing and 3,600 MAD after posting.

A 30 to 50% deposit is standard practice: it books the creator’s date and commits the client. Also price the options (an extra story, ad rights).

Which usage rights should the contract cover?

Law 2-00 allows an assignment or licence to be limited by right, purpose, duration, territory and means of use (article 42). With no territory stated, it covers Morocco; with no uses stated, it is limited to what the intended purpose requires.

UseWhat to write in the contract
Post on the creator’s accountPlatform, date, minimum time online
Reshare on the client’s accountsWhich accounts, and for how long
Paid ads (boosting)Duration, account used, extra price
Website, billboards, TVMedia, duration, territory, extra price

The creator’s moral right cannot be transferred (article 39): write down which edits the client may make to the video.

How do I label sponsored content in Morocco?

There is no influencer-specific law yet: a draft legal framework was announced in May 2025 and has not been adopted to date. The general rules apply:

  • Law 31-08, article 21: any false or misleading advertising is banned. Fine of 50,000 to 250,000 MAD, up to 1,000,000 MAD for a company (article 174).
  • Article 23: advertising shown to the public must clearly state that it is advertising and name the advertiser it was made for (fine of 10,000 to 50,000 MAD, article 176).
  • Platforms: Instagram requires the “Paid partnership” label, TikTok the commercial content disclosure setting, YouTube the paid promotion option.

What about cancellation and personal data?

The DOC lets the parties agree in advance on compensation for non-performance or delay, but the court can reduce it if it is excessive (article 264). Keeping the deposit after a late cancellation stays reasonable.

Image and voice are personal data (law 09-08, article 1). For a giveaway, inform entrants (article 5), get their consent (article 4) and do not send them promotions by message without prior consent (article 10).

How do clients and creators use this template?

  1. The client finds the creator in the Kreators directory and contacts them directly, for example by WhatsApp link.
  2. The client sends a brief (product, format, date, budget), priced with the rate calculator.
  3. Both sign the completed template before the deposit.
  4. After posting, the creator sends an invoice (invoice template) and the client pays the balance.

On the creator side, tax obligations are covered in the influencer tax guide.

Questions? Answered

Does a WhatsApp agreement count as a contract?

An electronic document has the same evidential value as paper if its author can be identified (article 417-1 of the DOC). A signed contract is still clearer.

Should I pay the influencer before the post goes live?

Standard practice is a 30 to 50% deposit on signing and the balance after posting, against an invoice.

Who is liable if an ad is misleading?

The advertiser, primarily (law 31-08, article 175). Complicity is also punishable.

Can I use a creator’s video in paid ads?

Only if the contract says so in writing, with the duration and media.

Does Kreators provide the contract or guarantee the partnership?

Kreators offers this template, but signs nothing on your behalf, does not guarantee the work and never handles payments: the client pays the creator directly.
